1. Agreement to Terms

These Terms of Service ("Terms") govern your access to and use of the website pubrescue.com and related services (collectively, the "Service") operated by PubRescue ("we", "us", "our").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Description of Service

PubRescue provides an online tool to convert Microsoft Publisher (.pub) files into other formats (such as PDF and Word) and to generate automated quality-check reports, including layout summaries, font warnings, and related deliverables.

The Service is provided on a free, no-registration basis subject to the usage limits described in Section 4.

3. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area, where applicable) to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

4. Free Tier and Usage Limits

The current free tier includes, without guarantee of future availability:

We may modify these limits, introduce paid tiers, or add registration requirements in the future. Material changes will be reflected on the website or in updated Terms.

If you exceed a limit, the Service may reject your request (for example, with an HTTP 413 or 429 response) and display an explanatory message.

5. Your Responsibilities

5.1 Lawful use

You agree to use the Service only for lawful purposes. You must not upload or process content that:

• Infringes intellectual property or other rights of any party
• Is illegal, defamatory, harassing, obscene, or otherwise objectionable
• Contains malware or is designed to disrupt systems
• Violates export control, privacy, or data-protection laws

5.2 Rights to your files

You represent that you own or have the necessary rights and permissions to upload and convert the files you submit.

5.3 Sensitive content

Do not upload files containing unnecessary sensitive personal data (for example, government IDs, financial records, or health information) unless you accept the risks described in our Privacy Policy, including temporary automated processing and deletion within 24 hours.

5.4 Prohibited conduct

You must not:

• Attempt to circumvent rate limits, security controls, or access restrictions
• Use automated scripts to abuse the Service (scraping, bulk conversion farms, etc.)
• Reverse engineer, decompile, or attempt to extract source code except where permitted by law
• Interfere with or disrupt the Service or its infrastructure
• Use the Service to develop competing services by systematically harvesting our outputs or documentation

We reserve the right to block IP addresses, reject requests, or suspend access when we reasonably believe abuse is occurring.

6. Conversion Results and No Guarantee

6.1 Best-effort service

PubRescue strives to preserve text and images where technically feasible and to provide useful quality-check information. However:

• We do not guarantee that any conversion will succeed
• We do not guarantee pixel-perfect layout reproduction, font matching, or compatibility with every .pub feature
• Some files may fail due to corruption, passwords, unsupported constructs, size, complexity, or processing timeouts
• Word export, where offered, may be labeled Beta and may produce less reliable results than PDF export

6.2 Your review obligation

You are responsible for reviewing converted outputs before relying on them for business, legal, printing, or archival purposes.

7. Intellectual Property

7.1 Your content

You retain ownership of files you upload. We do not claim ownership of your .pub files or converted outputs.

By uploading a file, you grant us a limited, non-exclusive license to process, temporarily store, and deliver conversions and quality-check deliverables solely to provide the Service you request.

7.2 Our content

The PubRescue name, logo, website design, documentation, and software (excluding your files) are owned by us or our licensors and are protected by intellectual property laws. You may not copy, modify, or distribute our materials except as permitted by these Terms or with our written consent.

7.3 Trademarks

Microsoft, Publisher, Windows, and related marks are trademarks of Microsoft Corporation. PubRescue is not affiliated with, endorsed by, or sponsored by Microsoft Corporation. See our About page and Disclaimer.

8. Privacy

Our collection and use of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference. Key points include:

• Files and derivative quality-check data are deleted within 24 hours
• You may delete files immediately from the results page
• We do not use your files to train AI or machine learning models
• We use cookies and third-party services including Google AdSense; see the Privacy Policy for details and consent options

9. Advertising

The Service is supported in part by advertising, including Google AdSense. Advertisements may appear on certain pages (for example, after conversion completes or within informational content areas).

Ads are labeled where appropriate and are separate from download and conversion controls. We do not use pop-up or pop-under ads that interfere with core navigation.

Your interaction with advertisers is between you and the advertiser and is subject to the advertiser's terms and privacy practices.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• PUBRESCUE AND ITS OPERATORS, AFFILIATES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE SERVICE
• OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD $100) OR THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER (IF YOU HAVE PAID NOTHING, THE CAP IS USD $100)

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to indemnify, defend, and hold harmless PubRescue and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Files you upload or outputs you distribute
• Your violation of these Terms or applicable law
• Your infringement of any third-party rights

13. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or pose a risk to the Service or other users.

Upon termination, Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and indemnification) will remain in effect.

14. Changes to the Service and Terms

We may modify, suspend, or discontinue any part of the Service at any time.

We may update these Terms by posting a revised version on pubrescue.com with an updated "Last updated" date. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms, except where applicable law requires otherwise.

15. Governing Law and Disputes

• No waiver: Our failure to enforce a provision is not a waiver of our right to do so later.
• Assignment: You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
